THIRTY-YEAR PLAN FOR DEVELOPMENT IN COSTALEGRE ANNOUNCED

The tourist area of ​​Costalegre, the second most important beach destination in Jalisco, will undergo a development plan over the next 30 years.

During a working tour of the region this weekend, Governor Enrique Alfaro Ramírez announced the Master Development Plan for that region, which includes the creation of a governance body that will be integrated by a Social Council and an Economic Council.

“The purpose is that we can have defined this year an agreement with the political, social, economic and academic actors of Costalegre to define the direction of this region,” said Alfaro Ramírez.

According to the governor, the master plan will guarantee the growth and development of the Costalegre region -integrated by the municipalities of Cabo Corrientes, Tomatlán, La Huerta and Cihuatlán- for the next three decades.

“It will start a new stage that will ensure that in 30 years the decisions we make today can guarantee that we live better here, that the environmental capital of this entire region is taken care of, that we can raise the quality of life of the people”, he said.

The master plan includes, among other actions, infrastructure works to improve communication channels, as well as the increase in equipment for social development with new schools and health modules.

The mayor of Tomatlan, Jorge Luis Tello García, demanded that the development plan be built with the help of environmental specialists to guarantee “the full exercise of rights” of its inhabitants.

The tourist project for Costalegre includes an investment of 3.8 million pesos for the construction of the southern highway that will connect Puerto Vallartawith the municipalities of La Huerta and Tomatlán.

According to Alfaro Ramírez, the environmental impact studies and the release of rights of way will be completed shortly, so this year the tender for the project that will unite the International Airport of Puerto Vallarta with Chalacatepec in just 50 minutes could be released.

Similarly, said the governor, the project is expected to consolidate a corridor of economic, social and environmental development in the area, for which, only 1.7% of the 743,300 hectares that make up the region will be urbanized and it would allow the construction of little more than 3,000 hotel rooms, mostly five-star hotels.

In the process of buying a property, there are two aspects that require special attention: one of course is obtaining title, the other, which is as important, is obtaining possession of the property you are buying. In Mexico, possession of a property is a very delicate matter and in many cases is not treated with the importance it deserves. Under our legal system, the concept of possession can be quite complex and may differ considerably from the legalities of possessing a property in the U.S. or Canada. This is why in dealing with this controversial topic, it is best if you are aware of some scenarios in which you should act within the scope of what is considered lawful.

What should I do regarding possession if I am buying property in Mexico?

If you are buying a property from the developer, the purchase contract should specify a specific date for the delivery of the unit, with penalties in case of default. When this delivery date comes, most certainly the developer will have you sign a contract in which you agree to the conditions in which the unit is being delivered, and if there are still details or work to be done in your condo, then you should specify that in the agreement (punch list), along with a due date for those details. You should also be aware that your one-year guarantee starts to count as of the day you take possession.

If I already own a property in Mexico, what are my do’s and don’ts in terms of possession?

Mexican law tends to protect the person in possession of a property, especially if that person obtained the possession through legal means, like for example through a lease agreement. The legal premise is that you can only evict someone through a ruling from a judge obtained after a proper trial. Without this ruling, evicting someone (either by denying access, locking out or changing locks or codes) can be considered a crime which is called Unlawful Dispossession of Property (or Despojo in Spanish) and this crime can be punished with up to 3 years in prison.

You might think that just by having title over a property you have superior rights over anyone who is in possession of that same property, but this is not always the case. That is why before evicting someone from your property, you should consider carefully taking this action without following the proper legal proceeding, since by not doing so, the consequences can be severe and may include criminal charges.

More and more Baby Boomers are moving to Mexico for retirement

Morgan Hill, California – A new “Expats In Mexico” online survey of people who are considering moving to Mexico found that 81 percent of Baby Boomer respondents said they will retire in Mexico, nearly 52 percent within two years.

“It’s not surprising that so many Baby Boomers, primarily from the U.S. and Canada, are considering retiring in Mexico,” said Robert Nelson, Expats In Mexico co-founder and author of Boomers in Paradise – Living in Puerto Vallarta. “I discovered this trend 11 years ago while researching my book and it has just continued to pick up steam.”

The Mexican government reported over 1.2 million expats were living in Mexico through 2017, the latest figure available. The 2000 Mexican census data showed just under 540,000 expats in Mexico. Americans represented over 80 percent of all expats living in Mexico two years ago, nearly 900,000.

Retirement is the main reason why Boomers and all respondents want to move to Mexico. Both groups also rated cost of living and better climate as top reasons to move.

“Mexico as a retirement destination for Baby Boomers makes sense,” Nelson said. “According to a recent report by the Stanford Center on Longevity, U.S. Baby Boomers hold less wealth, are deeper in debt and will face higher expenses than retirees a decade older than them. Why not live better in a nicer climate?”

But all is not perfect south of the border. About 45 percent of all respondents and Boomers say security issues in Mexico might be a concern for them. Lack of Spanish language skills and quality of healthcare were less important considerations.

Both Baby Boomers and all respondents selected Puerto Vallarta as their destination of choice, followed by the Lake Chapala area and Los Cabos. About 38 percent of all respondents and Boomers chose a wide variety of other locations in Mexico.

The self-selected online survey was completed by 337 respondents in January and February 2019. Respondents were primarily Americans and Canadians.

PUERTO VALLARTA CAN HELP BEAT THE WINTER BLUES

There’s no shame in looking for a sun-and-beach getaway in Puerto Vallarta and, with a comfortable 70 – 75 degrees average temperature for the upcoming spring months, it is the ideal place to relax away your winter blues. But for more active travelers, Puerto Vallarta’s location between the Sierra Madre Mountain Range and the Bay of Banderas provides multiple opportunities to help bring adrenaline levels up, too.

Puerto Vallarta is drenched in natural terrains ideal for an endless array of outdoor activities. Water sports enthusiasts can choose from every imaginable activity, from snorkeling and scuba diving to kayaking, sailing, water skiing, stand-up paddle boarding and surfing. The abundant marine life in the warm Pacific waters of Banderas Bay are known to be a fisherman’s paradise, offering some of the best deep-sea sports fishing around.

Those in search of hard-core adventure can go mountain-bike riding or zip lining, opt for a Jeep safari or go horseback riding in challenging terrains. There are also soft adventure tours of the jungle surrounding Puerto Vallarta, from canopy tours to eco-hikes. And, of course, more traditional sports pursuits, including tennis and world-class golf, are also all on offer in Puerto Vallarta, as well.

Visitors interested in bike-centered activities will find several local tour operators offer bike trips that fit everyone’s fitness and experience level, from beginner to expert; from bike taco tours to 3- or 10-mile climbs through the Sierra Madre to the shores of the Pacific Ocean and to a secluded beach or even the isolated town of Yelapa. Or, bikers can take a short trip to the “magical town” of Mascota, at 2.5 miles and over 12,000 feet above sea level, and riding through the region’s countryside to finally drop straight into the tropical paradise beach town of Puerto Vallarta.

Stand-up paddle excursions depart from Boca de Tomatlan and Colomitos Beach, south of Puerto Vallarta’s Historic Center. There, the calm and clear waters of the Bay of Banderas permit wild excursions. From November to March, marine life is abundant, and species visitors may encounter include multicolored tropical fish of all sizes, sea turtles, manta rays and eagle rays, among others. For a completely Puerto Vallarta experience, try paddle boarding just offshore along the seaside Malecon promenade at sunset, and increase your chances of catching a glimpse of dolphins or humpback whales.

Running is one of the most common sports practiced by both locals and visitors. Early runs along the Malecon and around the Historic Center are popular. Step up your run and throw in some mountains with a hike up the Mirador de la Cruz, for panoramic views of the city, or a run through Rio Cuale Island and up into the Conchas Chinas neighborhoods. For a more extreme experience, try a run along the 62-mile Bay of Banderas coast. The trail starts in the fishing village of Boca De Tomatlan, by a river that flows into a small bay, leads through the tropical jungle and over a rope suspension bridge to end at one of Puerto Vallarta’s most secluded beaches, Playa Los Colomitos. Runners may encounter a wide variety of exotic birds, butterflies, lizards and tropical trees along the way.

The groundbreaking ceremony took place last Friday on the beach at El Banco—the site of the residential complex—and was attended by investors, development executives, municipal and state authorities, and members of the region’s business community, among them, the Secretary of Tourism for the State of Nayarit, Ana Cecilia Llanos, and the Managing Director of the Riviera Nayarit Convention and Visitors Bureau (CVB) and the Bahía de Banderas Hotel and Motel Association, Marc Murphy.

“We’re very pleased with the trust the investors and developers have placed in us by creating these new tourism projects in the Riviera Nayarit,” said Marc Murphy. “Susurros del Corazón by Auberge Resorts is the type of investment the Bahía de Banderas Hotel and Motel Association and the Riviera Nayarit Convention and Visitors Bureau truly enjoy welcoming.”

“These are high-end, low-density hotels with specialized clientele: the type of tourist who likes to leave the hotel, go out to dinner, go shopping, and who generates important economic revenue. There’s no doubt this type of investment is a stimulus,” he added.

Meanwhile, Mark Cooley, partner, SV Capital Partners, developers of the resort and residences, stated it was very important for the company to preserve the natural beauty of the land and it was being conscious during the development to create a community that was in harmony with its surroundings.

“Punta de Mita is such a special place,” said Cooley. “We wanted to bring something totally unique to this area and the new Auberge resort hotel suites and stunning oceanfront villas deliver on our vison.”
The entire ethos of this property—he added—is to combine a rustic simplicity that feels very authentic with the world-class amenities expected from a quality Auberge resort.

By the same token, Craig Reid, executive director of Auberge Resorts Collection, pointed out that Susurros del Corazón will be an entirely new experience in Punta de Mita, one that embraces a laid-back beach spirit and perfectly balances luxury and approachability.
